Cowboys kicker Brandon Aubrey and jury convict man of assault, sentence him to 65 years

FORT WORTHD

allas Cowboys kicker Brandon Aubrey, serving on a Tarrant County jury since last Tuesday in a domestic violence case, helped find Daniel Rincones guilty on one of two assault charges. The jury sentenced Rincones to 65 years in prison. He was acquitted of the assault-strangulation charge but faced a severe sentence due to being a repeat offender. Rincones was previously convicted in 2019 of aggravated sexual assault, and his offenses involved household members, court records show.

During jury selection, Judge David Hagerman from the 297th District Court explained the trial schedule and asked potential jurors about any travel conflicts. Aubrey raised his hand, mentioning he had a work trip on Saturday. Defense attorney Rob Keating recalled, “He didn’t say he was a Cowboy,” though the judge and attorneys were aware of his profession. Aubrey’s job was not discussed further in court.

Keating didn’t confirm if prosecutors or defense attorneys spoke to Aubrey after the sentencing, a common off-the-record practice. Aubrey wasn’t the jury’s foreman, known as the “quarterback,” Keating added.

After the sentencing, Tiffany Rincones, the defendant’s ex-wife, expressed gratitude: “Tarrant County heard me and helped me protect others from a dangerous man,” she told the Fort Worth Star-Telegram.

Aubrey resumed Cowboys practice on Wednesday afternoon after his jury service. Though selected for the jury last Tuesday, he missed team practices but returned to Frisco for special teams training after trial days. During one game while the trial was ongoing, he made his only field goal attempt and all three extra points. The 2023 All-Pro kicker will be back at the Cowboys facility in full on Thursday.
